This Copyright & Content Policy (“Policy”) governs the use, ownership, protection, and enforcement of original content created, licensed, or managed by Beyond Your Means Productions LLC (“BYMP LLC”, “we”, “our”, or “us”). This policy applies to all content types including, but not limited to, music compositions, audio recordings, visual assets, written material, digital assets, and services described under any agreement or publishing contract.

1. Ownership of Content

All content on the BYMP website and associated platforms—including but not limited to text, graphics, logos, images, audio clips, video clips, musical works, compositions, recordings, arrangements, digital downloads, data compilations, and software—is the property of Beyond Your Means Productions, L.L.C. or its content suppliers and is protected by United States and international copyright laws. Beyond Your Means Productions LLC is the sole intellectual property of BYMP LLC unless otherwise agreed to in writing.Where BYMP LLC enters into a Music Publishing Agreement or similar arrangement, ownership rights shall be determined by that contract, which may include:

  • Transfer of administrative rights to a third-party publisher

  • Assignment of synchronization, mechanical, and performance rights

  • Rights to sub-license, monetize, and commercially exploit the work globally

2. User-Generated Content

Users may have the opportunity to submit content (e.g., comments, reviews, or other materials) to BYMP platforms. By submitting content, you grant BYMP a non-exclusive, royalty-free, perpetual, and worldwide license to use, reproduce, modify, publish, translate, distribute, and display such content in any media. You represent and warrant that you own or have the necessary rights to submit the content and that it does not infringe upon the rights of any third party.

Grant Of Rights

Unless otherwise agreed in writing:

  • Clients grant BYMP LLC the non-exclusive or exclusive rights (as stated in the Music Publishing Agreement) to use, reproduce, distribute, perform, display, and publicly exploit the musical works or content for the duration of the contract.

  • BYMP LLC reserves the right to publish, distribute, license, and sub-publish musical works both in the U.S. and globally.

  • Any work created under contract with BYMP LLC may be used for promotional purposes, digital platforms, streaming, licensing opportunities, or as reference work, unless a written agreement restricts such use.

Use Of Client Materials

Clients are responsible for ensuring they have the legal rights to any third-party content provided to BYMP LLC (e.g., samples, lyrics, video footage). BYMP LLC is not liable for any unauthorized or infringing materials provided by the client.

3. Prohibited Use of Content

You may not unless otherwise agreed in writing:

  • Reproduce, duplicate, copy, sell, resell, or exploit any portion of the BYMP content without express written permission.

  • Use BYMP content for any unlawful purpose or in violation of any applicable laws.

  • Modify or create derivative works based on BYMP content.

  • Use any BYMP trademarks or service marks without prior written consent.

  • Use content from BYMP LLC in a way that is defamatory, unlawful, or violates any third-party rights.

4. Royalties & Fees

Unless otherwise defined by contract:

  • Royalties and fees from exploitation of musical works will be shared in accordance with the agreement (typically 50/50 after an initial advance payment).

  • Any service fees (e.g., for auxiliary instruments, vocal coaching, music arrangements, video production) are priced per song and subject to change based on the musicians selected.

  • In cases of breach or unpaid balances, all rights revert to BYMP LLC, and clients may be subject to legal recovery fees.

5. Content Removal & Termination

BYMP LLC reserves the right to remove or disable access to any content at its sole discretion, especially in cases of:

  • Breach of agreement

  • Non-payment

  • Intellectual property violation

  • Platform or legal policy updates

Termination of publishing or service agreements will result in a final accounting of royalties due and revocation of access to active files unless otherwise agreed.

6. Digital Millennium Copyright Act (DMCA) Compliance

BYMP respects the intellectual property rights of others and complies with the provisions of the Digital Millennium Copyright Act (DMCA). All digital content distributed by BYMP LLC may include embedded watermarks, metadata, or copyright notices to protect against unauthorized use. Unauthorized removal or alteration of such protection mechanisms is strictly prohibited.

a. DMCA Takedown Notices

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement, please provide our designated DMCA Agent with the following information:

  • A physical or electronic signature of the person authorized to act on behalf of the owner of the copyright interest.

  • A description of the copyrighted work that you claim has been infringed.

  • A description of where the material that you claim is infringing is located on the BYMP website or services.

  • Your address, telephone number, and email address.

  • A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.

  • A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.

  • If infringement is confirmed, the content will be removed, and appropriate action will be taken.

b. Counter-Notification

If you believe that your content was removed or disabled by mistake or misidentification, you may submit a counter-notification to our DMCA Agent with the following information:

  • Your physical or electronic signature.

  • Identification of the content that has been removed or to which access has been disabled and the location at which the content appeared before it was removed or access was disabled.

  • A statement under penalty of perjury that you have a good faith belief that the content was removed or disabled as a result of mistake or misidentification.

  • Your name, address, telephone number, and email address.

  • A statement that you consent to the jurisdiction of the federal court in your district and that you will accept service of process from the person who provided the original DMCA notification.

Upon receipt of a valid counter-notification, we will forward it to the original complainant. If we do not receive notice within 14 days that the original complainant is seeking a court order to restrain you from engaging in infringing activity, we may restore the removed content.

7. Repeat Infringer Policy

In accordance with the DMCA and other applicable laws, BYMP has adopted a policy of terminating, in appropriate circumstances and at BYMP's sole discretion, users who are deemed to be repeat infringers. BYMP may also, at its sole discretion, limit access to the website and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

8. Limitation of Liability

BYMP LLC is not liable for:

  • Loss of profits or revenue related to third-party distribution

  • Delays in production due to unforeseen circumstances

  • Unauthorized use of content by third parties outside of BYMP LLC’s control

Termination of publishing or service agreements will result in a final accounting of royalties due and revocation of access to active files unless otherwise agreed.

9. Dispute Resolution

All disputes related to copyrights or intellectual property shall be governed by the laws of the State of North Carolina, and parties agree to settle claims in Pasquotank County, NC.

10. Changes to This Policy

This policy may be updated periodically to reflect legal, operational, or service-related changes. Clients will be notified of significant updates via email or official website notice.

11. Fair Use Disclaimer

BYMP acknowledges that certain uses of copyrighted materials may constitute "fair use" under Section 107 of the U.S. Copyright Act. If you believe that your use of BYMP content qualifies as fair use, please ensure that your use complies with the legal standards and consult legal counsel if necessary.
